DOJ Backs Legislation to End Gender-Based Medical Mutilation

On September 2, 2025, the U.S. Department of Justice took a decisive step in defense of America’s children by transmitting the Victims of Chemical or Surgical Mutilation Act (VCSMA) to Congress: a legislative proposal that aligns with the principles laid out in Executive Order 14187, which prioritizes safeguarding children from ideologically driven harm.

This landmark bill, championed by Rep. Bob Onder (R, MO-03) and Sen. Marsha Blackburn (R-TN), directly confronts the growing crisis of so-called “gender-affirming care” that has left countless families reeling from irreversible medical procedures performed on minors. The VCSMA prohibits healthcare professionals, hospitals, and clinics from participating in chemical or surgical interventions that alter a child’s healthy body parts to align with a gender identity different from their biological sex.

What the Bill Does

  • Bans puberty blockers, cross-sex hormones, and surgeries for minors unless medically necessary under narrow exceptions.
  • Defines sex as immutable and biologically determined at conception.
  • Creates a private right of action for children and their parents to sue providers who participated in these procedures.
  • Establishes strict liability for post-enactment violations, with potential for compensatory and punitive damages.
  • Protects detransitioners, allowing lawsuits up to 25 years after the child’s 18th birthday or 4 years after incurring detransition costs.

Attorney General Pamela Bondi underscored the urgency of this legislation, stating:

“The Department of Justice has heard from far too many families who have been devastated by mutilative medical procedures that fly in the face of basic biology. While we continue our ongoing legal battle to protect children, we appreciate our colleagues in Congress who are working diligently alongside us to end these abusive procedures once and for all.”
